Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

In no event shall Positive Travel and/or +impactTravel, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Positive Travel and +impactTravel its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components, or d) the results of using the Service will meet your requirements.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 (thirty) days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Introduction
Positive Travel is a brand of +impactTravel, an organisation established under Swiss Law in Geneva, Switzerland at 91, route de Peney, 1214, here after the “organisation” or “we/us”.
When you join Positive Travel as “member”, you are entitled to a service provided by the organisation. The word “member” or “membership” refers to your status as a member to these services.
These terms and conditions form the basis of the contract through which organisation will deliver the service. Upon subscription, you agree to these terms and conditions and you are providing us with the appropriate consent to handle your information in accordance with our Privacy Policy.
Membership Services
Members will benefit during the membership period from the following + Club members only service, including access to:
• Inside stories, tip and trends
• Mystery guest checked and rated members only details
• Secret places whose identification details are visible to members only
• The possibility to enter monthly draws to giveaways and prizes for stays and activities at our +hosts
• Member only events
• Other perks as detailed by your membership level
Conditions of membership – Membership period
Membership runs for 12 consecutive months from the date of membership subscription and its approval. Membership can be automatically renewed for the same period, unless members request a termination 30 days period to the end of the ongoing membership period.
Membership Fees
Members fees are paid on-line annually upon subscription and non-refundable. They are payable in euro (EUR) with the possibility of being converted into USD, GBP and CHF using the exchange rate of the day provided by your credit card supplier.
Conditions of membership – Membership cancellation
A member of has subscribed to + Club membership can cancel their membership anytime by contacting club@positive.travel.
Members who cancel their membership are removed from membership with effect from the date on which their resignation is received by the organisation and all their member benefits and rights cease at that time. Membership is annual and will not be reimbursed.
Conditions of membership – Member organisations obligations
The organisation expects of its members the highest standards of dignity, fairness and integrity. These values form the basis of our +Principles.
Events
Members may be invited to events organised by the organisation or by its partners if such events are considered to be of value and benefit to members. Our events may be subject to separate terms and conditions. Please check these at the time of booking.
Prizes and Competition Rules
All prizes and competitions which are associated with our offers are subject to separate terms and conditions, as written at the time of the prize draw, competition or offer.
Fee Information
Any fees displayed on our website are subject to change without notice.
We reserve the right to increase the fees of products and services. If this would be related to services subscribed by existing members, members will be informed 30 days in advance.
Governing law and jurisdiction
These terms and conditions are governed by the Law of Switzerland. If any court or competent authority decides that any of the provisions of these terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by the law.
A person who is not party to these terms shall not have any rights under or in connection with them.
Liability
Liability for 3rd parties: the organisations liability to its members will not extend to any membership related benefits, goods or services provided by an external provider. The organisation specifically excludes liability for any loss or damage suffered by a member as a result of their involvement in whatever manner with an external provider.
Accuracy of information: Reasonable effort is made to ensure the accuracy of information provided on our websites, in newsletters, and any other publications; however, neither we nor the authors can accept liability for errors and omissions within its publications.

Force Majeure
Neither party shall be liable to the other for any delay or non-performance of its obligations by reason of matters beyond its control including, but not limited to, any act of terrorism, war, riot, civil commotion, compliance with any law or government order, fire, flood or storm, strikes, other natural disasters and pandemics or any other industrial dispute, delay in transit, power failure, postal delay, or any event that cannot be reasonably be planned for or avoided.
Variations to this agreement
The originations may change these terms and conditions at any time upon giving its members 14 days prior notice. The most recent edition of these terms and conditions will be binding for members. Members may exit the contract if they do not accept any proposed variation. The new terms and conditions override any prior terms or conditions published in relation to any membership subscription between a member and the organisation.
If the privacy policies change, the organisation will notify its members and subscribers by e-mail or a special announcement placed on this website.
